Pay Kuwaiti KD 48,000 in damages as MoH refused to treat him abroad

KUWAIT CITY, Aug 15: Administrative Circuit at the First Instance Court has obliged the Ministry of Health to pay KD48,000 in compensation to a Kuwaiti citizen for damages he suffered due to the ministry’s refusal to send him for treatment abroad on the ministry’s expenses. The case file indicated the patient was admitted to the Farwaniya Hospital where he underwent an operation in the right leg after a traffic accident.

However, the operation was not successful and he was referred to Razi Hospital where he underwent another surgery. Representing the plaintiff, Lawyer Abdul Mohsen Al-Qattan said the patient (his client) applied for overseas treatment after the second operation in Razi Hospital, because technology for his successful treatment isn’t available in Kuwait but the health ministry concluded that his condition wasn’t serious enough; thereby his application was rejected. The patient filed a case in court and again it was rejected.

He spent five years undergoing treatment in Kuwait without progress in spite of free treatment all Kuwaiti citizens are entitled to.
